Policies & Contract

Please carefully read this document and sign it at the bottom of this page to indicate you’ve read and agree to follow these policies.  By paying the retainer fee, you agree to these terms and conditions.

This is an agreement between Boudoir by Kati Lynn (“we” and “our”), and the client signing the document (“you” and “your”).

BOOKING YOUR APPOINTMENT
To hold your date, you agree to pay the retainer fee. The session retainer fee is a non-refundable reservation fee to hold your session date. We do not hold session dates and times until we have received the session fee paid in full. We agree that once we’ve executed this agreement, we will not book other sessions at your date and time.

FORMS OF PAYMENT
We accept payment by credit card, via PayPal credit, Affirm, AfterPay and cash

BOUDOIR SESSION
You are booking a boudoir session.  That means you will be photographed in lingerie and possibly nude, and posed in provocative ways.  It is likely that our team will touch you to adjust your clothing and hair or to direct a pose.  We will probably see you with no clothes on.  You must be 18 years old to do a boudoir session with us.  You are booking this session of your own free will.

CANCELLATIONS / RESCHEDULES / NO-SHOWS 
If you reschedule or cancel your boudoir portrait session for any reason, we will suffer losses that are difficult to ascertain and a fee will be collected. The reschedule/cancellation fee schedule is spelled out below:

  • 30 days’ notice: $50

  • 14 days’ notice: $100

  • 72 hours or less notice: $250

The fee is paid to us as liquidated damages and not as a penalty.  We will try to book your date and if we are able to book your date, no fee with be collected.

If you let us know that you need to reschedule your session more than 30 days before your scheduled time, you may apply your retainer to your new session date if:

  • You schedule your new date within 24 hours of telling us you wish to reschedule.

  • Your new date falls within 180 days of your original date.

  • It is your first time rescheduling your boudoir session.

  • You may only reschedule one time.

If you do not meet all of these conditions, you forfeit your retainer fee. Your retainer fee is not transferable.

The client is allowed 1 reschedule with no penalty/fee. Each following rescheduling will incur a new $500 retainer fee.

New Studio Policies and Current Pricing: If you reschedule your session, you will be held to the Studio Policies and Product and Pricing Guide that is current at the time of your rescheduling.  A new contract will be signed.

REFUNDS
Due to the custom nature of our products and services, you hereby ratify your understanding that all product sales and retainer fees are non-refundable and waive any rights to charge-back your purchase with your credit card processor.  Boudoir by Kati Lynn will not process a refund.  

HAIR + MAKE UP STYLIST SERVICES
Hair + make up services are mandatory for our boudoir clients, and the cost of these services is included in the boudoir retainer fee. If you decide not to use our expert hair + make up professional, your session fee remains the same.

While our team does our best to style everyone in the photographs in an attractive manner, you are ultimately responsible for choices in wardrobe, makeup and hairstyle. Please be sure to tell us if you’d like anything changed before we start shooting. No refunds or re-shoots are available if you dislike your styling in your final photographs.

COPYRIGHT
All photographs produced during your photography session are protected by US Copyright Law. We are the sole owner and copyright holder of every image taken under this contract. Any unauthorized use of the photographs we make during your portrait session will be prosecuted to the full extent of the law. Please note that any reproduction of our work, including taking screenshots or photos of finished items, is a violation of Copyright Law. Any unauthorized altering and display of our work without our express written permission is in violation of Copyright Law.

PRIVACY
We agree not to post your images online or use in print marketing without your expressed, written, permission.

DIGITAL IMAGES & LIMITED — USE RELEASE
When you purchase digital images, you receive a limited use release. Your release will be included with your purchased images. Unless you purchase, or we grant you, a separate commercial use license, your photos are for PERSONAL USE ONLY.  Please note that, other than cropping to fit specific social media photo dimensions or print photo dimensions, you may not change your photograph in any way, including but not limited to: changing the color, adding or subtracting elements or re-editing.

You can:

  • Post the web-sized images online, including on Facebook and any personal blog or website that does NOT receive advertising revenue.

  • Print appropriately sized images in any manner you wish (prints, canvases, albums).

  • Pin the web-sized images on Pinterest with the following identification in the comment: Photo by Boudoir by Kati Lynn,  https://www.boudoirbykatilynn.com.

You cannot:

  • Enter the photos into a contest.

  • Sell the photos to a third party or make a profit from them.

  • Use them in any commercial project, including but not limited to: business websites, and blogs that receive advertising revenue WITHOUT MY EXPRESS WRITTEN PERMISSION IN A COMMERCIAL USE LICENSE.

  • Alter the photos in any way, excluding cropping, changing colors, adding or subtracting elements.

LIMIT OF LIABILITY
We will make every effort to provide high-quality photography services. We take the utmost care with respect to exposure, transportation and processing of photographs, using professional equipment and backup equipment.

In the unlikely event that your photographs are lost, stolen destroyed for reasons beyond our control, we will photograph you again if possible.

If a re-shoot is not possible, our liability is limited to the return of all payments you’ve made to us, including the retainer fee. The limit of liability shall not exceed payments made by you.

NO SPRAY or SELF TANNING
You agree not to have a spray tan or use self-tanner at least 14 days before your session. Should any tanning agent cause damage to our props, linens, furniture or other items you will be liable for the cost of those items up to the full replacement cost. You will possibly look orange, and the retouching fee to bring your skin color back to normal is $25 per image.

PHOTO EDITING & RETOUCHING
Every photo you are presented will be corrected for exposure, white balance, sharpness, brightness and contrast. Your photographs will also be edited for skin smoothness, removing blemishes and other minor cosmetic changes. We will deliver photos that are edited to the best of our ability. Some types of retouching may incur an additional charge, including but not limited to:

  • Removal of very large tattoos

  • Color-correcting fake tans

If you request additional retouching at your gallery reveal + ordering session or when viewing your album proof, you may incur a charge of $25 per image, per round of edits, at our discretion.

We do not release unedited or RAW images.

ORDERING SESSION, PRICING, & PAYING FOR PRODUCTS
After your session, we’ll meet for your gallery reveal + ordering session at the studio. During this meeting, you’ll select your images and order products. 

If you choose not to participate in your reveal and ordering session that day, and refuse to schedule an ordering session within 21 days of your session date, your photos will be deleted unless other arrangements have been made. The ordering session is your opportunity to purchase your images. All decision makers must attend this session. Because of the sensitive nature of your photographs, we do not post online galleries. If you choose not to place an order at this appointment, your photos will be deleted within 24 hours.

Payments are due in full at your ordering session. A second ordering session is $150.

Due to the custom nature of our products, no refunds, returns or order cancellations are available once you have placed your order.

In-house Payment Plans:  All pre-session payments will be used as a gift card toward your purchase during your reveal and ordering appointment.

PayPal Credit/Affirm/Klarna: Our clients may obtain a credit line through PayPal Credit, Affirm, or Klarna. With this option, the client deals directly with PayPal Credit, Affirm, or Klarna for payment arrangements. With this option, the photography products are designed and the order is placed immediately.

Pricing Menu: We will adhere to the current pricing booked under and written into this agreement.

PRODUCT DELIVERY, RUSH ORDERING & SHIPPING
Digital photographs: Digital photographs are delivered via WeTransfer. Please back up your photos immediately and keep them safe for future use.

Product orders: We will order your products within 3 business days of your gallery reveal + ordering appointment. Our lab typically takes upto 4-6 weeks for product delivery. You agree to have print products shipped via a third-party shipping company (FedEx, UPS, etc.) to the address provided with no signature required for delivery. Multiple items may arrive in separate shipments. You may request to have print products shipped to the studio location and arrange an in-person pick-up.

Rush & administrative fees: If you need to receive your products faster, please tell us at your gallery reveal + ordering session. You may pay a rush fee on editing, albums, prints and canvases, plus charges for expedited or upgraded shipping, and any administrative fee.

SALES TAX
Georgia sales tax will be added to all product orders. This includes digital photographs.

LIMIT OF FILE STORAGE
We typically keep the edited full-resolution images presented to you in your gallery for 3 months, unless you fail to schedule an ordering appointment within 21 days of your session. Should you fail to place an order within 21 days, your files will be deleted upon that date. We may delete, destroy or erase them at any time and without notice. We recommend that you create multiple backup copies of any digital products and store them in a secure place.

LOCATION DAMAGES
In the event of equipment loss or damage to the studio resulting from guest misconduct, the client understands they may be held liable for recovery of any costs incurred as a result of such equipment loss or damage.

WEAPONS
Weapons are not permitted in the studio (guns, knives, swords, bows, etc...).

ANIMALS
Animals are not permitted in the studio.

PROPS/COSTUMES
We typically do not photograph props or costumes. If photographed, it will be at the photographer's discretion.

AGREEMENT
This agreement between Boudoir by Kati Lynn, and the client, named below is governed by the laws of the State of Georgia. Any disputes will be handled through arbitration.

I have read and accept the terms and conditions stated above. I am legally allowed to enter into binding contracts. I authorize this contract to be valid approval for photography sessions without additional signed contracts or written authorization.
